In his notice to the CM, Saxena wrote, “This is regarding Cabinet Decision… stating that ‘the Council of Ministers has decided to convene a one-day Session of the Seventh Legislative Assembly on 17.04.2023’. My Secretariat is also in receipt of a letter dated 15.04.2023 of the Delhi Legislative Assembly Secretariat informing the commencement of the Second Part of the Fourth Session of the Seventh Legislative Assembly… I fail to understand as to under what circumstances and under which provision of the GNCTD Act, 1991, the Second Part of the Fourth Session (Budget Session) of the Seventh Legislative Assembly has been convened instead of moving a proposal for Prorogation of the Budget Session and convening of the ‘One Day Session’ as per the Cabinet Decision.”
The price range session of the meeting was adjourned sine die on March 29.
Writing to Kejriwal that the session referred to as on Monday shouldn’t be convened with out following due process, Saxena mentioned, “It is very unfortunate to bring it on record that consequent to the Cabinet Decision, proposal to Prorogue the Budget Session, already adjourned sine-die… or summoning of one-day Session of the Assembly as per the aforesaid Cabinet Decision has not been received in my Secretariat… there is no indication of any Legislative Business proposed to be transacted… This also needs to be reflected in the Cabinet Decision as per rule(s)… to allow the members of the House to come prepared for fruitful deliberations.”
Officials mentioned that because the price range session was not prorogued, and easily adjourned sine die, the right course of can be to first prorogue the price range session earlier than calling for a particular session.
“I expect that in the interest of democratic values enshrined in the Constitution, such statutory procedures and parliamentary practices should not be ignored and done away with. Therefore, I would advise you to direct the concerned Department to submit an appropriate proposal to prorogue the Fourth Session (Budget Session) of the Seventh Legislative Assembly with immediate effect and for summoning ‘one-day session’ in accordance with provisions…”
