Can a lady be booked in a rape case? The Supreme Court has agreed to look at this after a lady petitioned it for anticipatory bail in a rape case additionally involving her son. The SC requested the Punjab authorities to answer the plea filed by a 61-year-old girl who has been named in a case filed by her daughter-in-law.
Agreeing to look at the difficulty, Justices Hrishikesh Roy and Sanjay Karol granted the girl safety from arrest and directed her to cooperate with the investigation.
Advocate Rishi Malhotra, who appeared for the girl, argued that every one different penal sections within the FIR are bailable barring the cost underneath IPC Section 376(2)(n) (repeated rape). Referring to an SC judgment, Malhotra stated a lady can’t be charged with rape.
According to the case, the complainant was initially in a long-distance relationship with the US-based elder son of the girl, a widow. The FIR states that the complainant began dwelling along with her after marring her son in a digital ceremony. Later, the youthful son of the widow visited them from Portugal.
The widow has claimed when the youthful son was leaving for Portugal, the complainant insisted that he take her alongside however he left alone. The widow stated she gave the complainant Rs 11 lakh for ending the wedding along with her elder son. The complainant lodged an FIR in opposition to the widow and her youthful son, accusing them of rape.
