The company has filed a suit for copyright infringement, wrongful termination and damages against Hakuhodo Group of companies.

Gravity Entertainment Private Limited, an experiential marketing agency headquartered in Gurugram has filed a suit for copyright infringement, wrongful termination and damages against Hakuhodo Group of companies along with an interim application for injunction against Hakuhodo from infringing on Gravity’s copyright with respect to work created by Gravity for Hakuhodo for the launch of a product for one of their clients.

The suit along with the application was listed on August 14th wherein notice was issued to Hakuhodo and the same has been relisted for hearing on the injunction application on 17.08.2020.

Gravity created artistic work for a prospective pitch to a client in collaboration with Hakuhodo on the basis that Gravity will be the recipient of the project if they win the pitch. The consortium of Gravity + Hakuhodo won the pitch but Hakuhodo went against the agreement and Gravity was dropped from the project after it was awarded to the consortium.

It is also noteworthy to mention that Hakuhodo used Gravity’s intellectual property viz ideas and storyboards and outsourced it to other enterprises to execute the pitch won together with Gravity.

While many agencies would have probably taken this lying down to avoid any industry conflicts, the team at Gravity decided to go forward with legal action and file for an injunction.

More details on this particular case will emerge post the court hearing.
