Hearings begin today on controversial Sudbury development on the Kingsway | CBC News

Gordon Petch, the lawyer representing business owner Tom Fortin,  university professor Christopher Duncanson-Hales, and the downtown BIA presented his arguments in an LPAT appeal today, underway in Sudbury.

Petch argued the city did not properly study the economic impact and social impact of building the proposed casino, arena and event centre complex in its plans for developing the Kingsway Entertainment District with partner Dario Zulich.

Construction was expected to be completed this year, but the project has been held up by legal challenges.

In September, a Superior Court ruled in the city’s favour on issues around the process the city followed in approving the development. Petch suggested his clients might appeal that decision.

Another appellant, local activist Steve May, is representing himself.  

The matters before the Local Planning Appeal Tribunal (LPAT) involve the plans themselves, including concerns around building a casino, and moving the arena out of downtown Sudbury.

Representatives for the city, Gateway Casinos, and developer Dario Zulich will each have 75 minutes to present their oral arguments this afternoon.

The hearing could conclude today, but there is also time set aside tomorrow if necessary
