The owner of the Sudbury Wolves is claiming victory after the Superior Court of Justice struck down an attempt to stop the construction of a new arena in the Kingsway Entertainment District.

“It’s now time for us all to put this behind us and work together to grow Greater Sudbury,” Dario Zulich of SW Sports & Entertainment said in a release issued Friday.

Businessman Tom Fortin had gone to the courts, seeking to strike down a city council decision and rezoning approval to build a $100-million arena/events centre at the Kingsway Entertainment District, or KED.

Fortin had argued council was fettered — or biased — in favour of the KED location.

The City of Greater Sudbury also welcomed the court’s ruling.

“The City of Greater Sudbury is pleased with the decision rendered by Regional Senior Justice Ellies on the Kingsway Entertainment District (KED),” it said in a statement. “City staff will now take some time to review the documentation and bring the clarified details and information to City Council as soon as possible.

“This is a positive step forward, and we are confident we can expect to see similar results resolving the appeals to the Local Planning Appeal Tribunal (LPAT) that will allow the City of Greater Sudbury to proceed with its plans for modernization and development as planned in 2017.”

The arena, however, still has obstacles to overcome. As the city mentioned, the Local Planning Appeal Tribunal will hear challenges against the project later this month.

And next week, city councillors will be asked to consider refurbishing the existing downtown arena, rather than building a new one at the KED.
